If he's used to a schedule then quite probably that is the issue, combined with the stress of losing his home and family. Being on a schedule should make it easier to housebreak him to his new home.

Whether he is getting too much freedom will quickly become apparent. If he starts getting into trouble, obviously he needs more restriction and supervision until he learns the rules of the household. If the rules are ones he's already familiar with, then he should settle in with a little less hassle.

You may want to call the breeder and ask about the situation she may be able to give you an answer on his potty habits.
